PUBLIC AWARENESS NOTICE

REPLACEMENT OF THE TRAFFIC FINES ON-THE-SPOT (FOTS) SYSTEM BY NEW FIXED CHARGE SYSTEM FROM 3RD APRIL, 2006.

The introduction of the Fixed Charge System is scheduled to be introduced in place of the Traffic Fines-On-The-Spot system from 3rd April, 2006. The current system will cease from midnight on 2nd April, 2006.

HOW NEW LEGISLATION FOR PARKING OFFENCES WILL AFFECT YOU

Fixed Charges:

  • All previous 19.00 Euro parking offences have increased to 40.00 Euro with the exception of parking a vehicle illegally in a disabled persons parking bay, which has increased to 80.00 Euro.
  • In respect of an offence under Section 73 of the Finance Act 1976, requiring a licence to be fixed to and exhibited on a vehicle, the fine in this case remains at 60.00 Euro.

Payment of Fine

(a) If during a period of 28 days, beginning on the date of the fixed charge notice, you pay the fixed charge appropriate to the alleged offence, to Kilkenny Borough Council, City Hall, High Street, Kilkenny, no prosecution will be instituted.

OR

(b) If you do not make the payment specified during the period indicated at (a) above, you may make a payment of an amount 50% greater than the amount specified in the notice within a period of 28 days beginning on the expiration of the first period of 28 days, no prosecution will be instituted.

The Act provides that no payment of a fixed charge can be accepted after the expiration of the 56 day period and court proceedings are initiated against those who opted not to make a payment.

Nomination of Driver If You Were Not Driving the Vehicle

You should not later that 28 days after the date of the fixed charge notice forward to Kilkenny Borough Council, City Hall, High Street, Kilkenny, a document in the prescribed form signed by you, the registered owner, stating the name and address of the person who was driving or otherwise using the vehicle at the time of the alleged offence. This prescribed form will be attached to the Fixed Charge Notice. A person who provides false or misleading information or fails to provide information shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding €800.
