NOTICE TO THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960 AND AMENDED AND EXTENDED BY THE PLANNING AND DEVELOPMENT ACTS, 2000 – 2010 INCLUDING

SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT, 2000;

LOCAL GOVERNMENT ACTS, 1925-2009 INCLUDING LOCAL GOVERNMENT (No. 2) ACT, 1960 ; ROADS ACTS, 1993 – 2007
AND ALL OTHER ACTS THEREBY ENABLING  

Kilkenny County Council (hereinafter referred to as “the local authority”) on its own behalf and on behalf of Kilkenny Borough Council [pursuant to agreements under Section 85 of the Local Government Act 2001] in exercise of the powers conferred upon them by section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by section 10 of the Local Government (No. 2) Act, 1960 as substituted by section 86 of the Housing Act, 1966 as amended by section 6 of and the Second Schedule to the Roads Act, 1993 and as amended and extended by the Planning and Development Acts, 2000- 2010 , have made an order entitled as above which is about to be submitted to An Bord Pleanála for confirmation , having regard to the exercise by An Bord Pleanala of its powers under Section 217B of the Planning and Development Acts 2000-2010 by Notification dated 7th July 2009.

If confirmed, the amended Compulsory Purchase Order  will authorise the local authority to acquire compulsorily the land described in the First Schedule hereto for the purposes of the construction of the  altered road development known as the Central Access Scheme for the City of Kilkenny, having regard to the exercise by An Bord Pleanala of its powers under Section 217B of the Planning and Development Acts 2000-2010 by Notification dated 7th July 2009.

Owners , Lessees and Occupiers of the land described in the schedule will receive individual written notice.

The Board may, at its discretion, decide not to confirm the amended compulsory purchase order in respect of the land referred to in the Schedule if an objection is made and not withdrawn in respect of the acquisition by an owner, lessee or occupier of the land, until it has caused to be held an oral hearing in respect of the amended compulsory purchase order and until it has considered the objections and the report of the person who held the oral hearing.

A revised environmental impact statement has been prepared in respect of the proposed  road development as altered, to which the compulsory purchase order relates

Evidence in relation to the likely effects on the environment of the altered road development may also be heard at any oral hearing in respect of the amended compulsory purchase order or altered road development having regard to the exercise by An Bord Pleanala of its powers under Section 217B of the Planning and Development Acts 2000-2010 by Notification dated 7th July 2009.
